2025 Blue Rodeo Charter Cruise Terms and Conditions
Stewart Travel Group Inc. and its Associate Agents act only in the capacity as an agent for the transportation companies including air, sea, land, hotels, or other forms of accommodation, restaurants, places of entertainment and other such services when reserved for its customers and as outlined in your personal itinerary.
In the event of Stewart Travel Group Inc. and its Associate Agents offering or selling a tour, cruise, package holiday reserved with a tour operator, Stewart Travel Group Inc. and its Associate Agents act only as agent for the tour operator. The tour operator will have made all arrangements with the suppliers of various travel services relating to your itinerary.
LIABILITY
Stewart Travel Group Inc. and its Associate Agents shall not be responsible or liable to their customer for any claims, loss or damages, cancellations or expenses arising out of injury, whether physical or mental, accidental, death or delay or inconvenience to the customer or any other person, or damage to luggage or other personal property from any cause whatsoever.
To the best of Stewart Travel Group Inc. and its Associate Agents’ knowledge and information, the description and information provided about the various services set out in the itinerary are accurate. However, Stewart Travel Group Inc. and its Associate Agents shall not be liable to the customer if any of the services provided by the suppliers do not conform to such descriptions, living standards and practices at the destination and the standards and conditions there with respect to the provision of utilities, services and accommodation may differ from those found in Canada. If a passenger onboard causes any damage to the ship they will be 100 % responsible to rectify it directly with AmaWaterways, Stewart Travel Group Inc. will not be responsible whatsoever.
TRAVEL SERVICE
All arrangements are subject to the terms and conditions imposed by the transportation companies, airline, hotels or other forms of accommodation, restaurants, places of entertainment, the tour operator, cruise companies and other such travel services, if any, and accordingly maybe subject to charges and/or restrictions for any changes or cancellation.
You are responsible for reading the terms and conditions that accompany all your travel documents. We will provide you with printed material (e.g. supplier brochure) when requested by the traveler or travel organizer if available to Stewart Travel Group Inc. and will explain all that is related to the services purchased. These suppliers are independent third parties over whom we exercise no direct control.
CANCELLATION AND CHANGES
Cancellation penalties are 100% non-refundable. Travel service arrangements by other suppliers such as airlines, hotels, pre cruise tours also may not be changeable, or they may be changeable only upon payment of a fee that is determined by the travel service provider.
FEES
Your Receipt/Invoice may include charges from Stewart Travel Group Inc. and its Associate Agents for administration fees, which are non-refundable. Additional fees and/or restrictions may apply to reservation changes and/or cancellations.
COLLECTING AND USING PERSONAL INFORMATION
Stewart Travel Group Inc. and its Associate Agents may, from time to time, collect personal information about you as result of your relationship with us. Stewart Travel Group Inc. and its Associate Agents may collect, use and disclose such personal information to determine your eligibility for and interest in products and services from Stewart Travel Group Inc. and its Associate Agents, its affiliates or carefully selected third party business partners. We may also use this information to establish, maintain, and manage your relationship with Stewart Travel Group Inc. and its Associate Agents and to provide you with ongoing services and for other uses as set by our Privacy Policy (www.stewarttravelgroup.ca for more information). We may ask you for contact information including the telephone number you have provided in connection with these travel services. We may keep and use this information as well as disclose it to our affiliates and carefully selected third party business partners so that we may contact you for marketing purposes. As you do business with Stewart Travel Group Inc. and its Associate Agents, we may monitor and/or record your telephone conversations with our customer service representatives to ensure service quality. Stewart Travel Group Inc. and its Associate Agents retain your personal information only as long as required for our reasonable business and/or legal needs.
ACCESSING PERSONAL INFORMATION AND WITHDRAWING CONSENT
Any person whose personal information is kept by Stewart Travel Group Inc. and its Associate Agents may access such personal information, request corrections to it, ask questions about it, or withdraw their consent to the collection, use, and disclosure of their personal information at any time, subject to legal or contractual restrictions and reasonable notice, by contacting Stewart Travel Group Inc. and its Associate Agents in writing at 96 Kennedy Drive, Charlottetown PE C1E1X7.
TRAVEL DOCUMENTATION
When purchasing travel through Stewart Travel Group Inc. and its Associate Agents, you remain fully responsible for obtaining the correct documentation necessary for entry into your destination, intermediary point(s), and re-entry into Canada. You also understand that entry into any country may be refused even if the required information and travel documents are complete and that Stewart Travel Group Inc. and its Associate Agents accept no responsibility for these decisions.
You also understand that your Canadian passport must have a validity of 6 months or longer than your intended travel time for international travel. (NOTE: If you are traveling on a passport that is not Canadian notify your Trusted Travel Advisor.)
You also confirm that the first, middle and last names of travelers provided to Stewart Travel Group Inc. and its Associate Agents are as they appear on your travel documents, passports, visas, and other government-issued identification. Stewart Travel Group Inc. and its Associate Agents will take no responsibility for errors due to the provision of incorrect information by the traveler.
RECONFIRMING FLIGHT TIMES AND CHECK-IN
It is your responsibility to confirm your flight departure times at least 24-48 hours prior to departure. Some airlines will have schedule changes and your flight times may differ to what is stated on your Itinerary. We recommend that you reconfirm your onward and return flights at least 3 - 7 days prior to each journey. Stewart Travel Group Inc. is not responsible for schedule changes.
All passengers are asked to check in at least 2 hours for domestic and 3 hours for international prior to the scheduled time of departure of their flight due to enhanced security measures. We recommend online check-in available with most airlines at least 12 hours prior to departure and for most cruises, at least 72 hours. Please note that all travelers must be present with their boarding documents, passport and visas necessary for the destination. Any passenger arriving late for check-in will be denied boarding.
BAGGAGE ALLOWANCE
The customer must consult the terms and conditions of the applicable airline and tour supplier for restrictions on the number and weight of baggage on chartered and scheduled service. Lost or damaged baggage is the responsibility of the airline, which may have limited liability. Stewart Travel Group Inc. recommends the purchase of insurance for loss of, or damage to, baggage. In the event of damaged, lost or delayed baggage, please contact the applicable airline representative prior to leaving the airport. Failure to do so will invalidate the customer's claim. Note: Additional baggage fees may apply based on the airline and tour supplier you have selected.
TRAVEL AND HEALTH INFORMATION
For the most current worldwide Travel & Health information, consult your family physician or visit the Travel Health & Safety division of the Government of Canada official website at http://travel.gc.ca/travelling/health-safety. You'll find information on recent outbreaks, travel advisories, required vaccinations, safe food and water tips, insect protection, illness and injury abroad, and more. If original tour date is postponed to a future date due to circumstances out of our control, no refund will be offered and all funds paid for original dates will be automatically moved to new tour dates if possible.
INSURANCE
Stewart Travel Group Inc. offers the customer the option of purchasing travel insurance, including trip cancellation insurance and out of province health insurance, COVID -19 to insure the customer against the risks described in the applicable policy that may occur prior to, during or after the customer's trip. It is recommended that the customer purchase travel insurance.
There are different types of insurance packages available. Travel insurance may only be purchased by the customer within 72 hours of purchasing the travel services to which the insurance relates or prior to the day of departure, whichever is earlier (excluding out of province medical only insurance, which may be purchased anytime up until departure). The customer also may change the type of insurance coverage purchased only within the same period. To make an insurance claim it is the customer's responsibility to contact the insurance carrier as soon as possible. Please contact Stewart Travel Group Inc. if more information regarding travel insurance is required.
The customer acknowledges that it has been made aware of the availability of travel insurance coverage, including trip cancellation insurance and out of province health insurance, and the customer has either purchased or declined to purchase that insurance prior to completing the purchase of travel services.
MAILING LISTS
If you would like to join our mailing list and be informed of seat sales, last minute vacations and other promotional offers, we ask for your name, address, phone number and email address. We use this information to communicate to you via email. For certain opt-in services, Stewart Travel Group Inc. may collect profile information about you (e.g. hotel and car preferences, etc), as well as demographic information (e.g. education level, etc). This information will be used to communicate specific information to you based on the profile and demographic information you provide.
SPECIAL CHARTER CRUISE TERMS & CONDITIONS WITH AMAWATERWAYS
LIABILITY DISCLAIMER: We arrange with others for the services described in these Terms, your confirmation and/or our brochures. Carriers and Suppliers are independent third parties which are separate entities and are deemed not to be our principals, agents, employees or partners. WE ACT SOLEY AS A SALES AND MARKETING AGENT FOR THE CARRIERS AND SUPPLIERS AND DO NOT OWN OR OPERATE ANY SHIP OR OTHER MODE OF TRANSPORTATION, HOTEL OR ACCOMMODATION. ACCORDINGLY, WE DISCLAIM RESPONSIBILITY AND LIABILITY FOR, AND PARTICIPANT WAIVES, RELEASES AND ACKNOWLEDGES THAT THERE SHALL NOT BE ANY CLAIM OR RECOURSE AGAINST US FOR OR AS A CONSEQUENCE OF: BREACH OF DUTY, BREACH OF CONTRACT, NEGLIGENT OR WILLFUL OR INTENTIONAL ACT, FAILURE TO ACT OR OMISSION BY ANY CARRIER OR SUPPLIER. Carrier, Supplier and participant obligations and liabilities are subject in each case to terms and conditions of the Passenger Ticket Contract and each Supplier’s contract, and any and all laws, regulations and international conventions that apply under those contracts, including, but not limited to choice of law, jurisdiction for disputes, limitations of liability, and time limitations for claims and suits. PARTICIPANT AGREES THAT WE SHALL NOT BE LIABLE FOR ANY DAMAGE, LOSS (INCLUDING PERSONAL INJURY, DEATH, AND LOSS OF OR DAMAGE TO PROPERTY) OR EXPENSE OCCASIONED BY ANY ACT OR OMISSION OF ANY CARRIER OR SUPPLIER, OR ANY PROVIDER OF A TRAVEL PROTECTION PLAN, OR INSURER, OR OF ANY OTHER PERSON. If the services of a Carrier or Supplier cannot be delivered or there are changes in any planned service for any reason beyond our control, we will make an effort to arrange similar services. Any resulting additional expenses will be participant’s responsibility. UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THESE TERMS, THE PASSENGER TICKET CONTRACT, THE CRUISE OR ANY RELATED TRAVEL OR ACTIVITIES, AND OUR LIABILITY, IF ANY, SHALL IN NO EVENT EXCEED THE AMOUNT PAID TO US FOR THE TRAVEL.
PASSENGER TICKET CONTRACT: ALL SHIP TRANSPORT IS PROVIDED ACCORDING TO THE TERMS AND CONDITIONS OF THE PASSENGER TICKET CONTRACT, WHICH IS SENT AT THE TIME OF BOOKING, IS INCLUDED IN THE DIGITAL TRAVEL DOCUMENTS SENT PRIOR TO THE CRUISE AND IS AVAILABLE FOR REVIEW AT WWW.AMAWATERWAYS.COM. THE PASSENGER TICKET CONTRACT ESTABLISHES LIMITS OF LIABILITY, LIMITS ON CLAIMS, AND TIME LIMITS FOR MAKING CLAIMS, AS WELL AS OTHER RESTRICTIONS, LIMITS AND DISCLAIMERS OF CARRIER’S LIABILITY FOR YOUR DEATH, ILLNESS, INJURY, OR DAMAGE CLAIMS RELATING TO BAGGAGE OR PERSONAL PROPERTY. IT IS GOVERNED BY SWISS LAW AND INCORPORATES PROVISIONS AND LIMITATIONS UNDER THE ATHENS CONVENTION RELATING TO THE CARRIAGE OF PASSENGERS AND THEIR LUGGAGE BY SEA, 1974, AND THE PROTOCOL TO THE CONVENTION RELATING TO THE CARRIAGE OF PASSENGERS AND THEIR LUGGAGE BY SEA, 1976, THE INTERNATIONAL CONVENTION ON LIMITATION OF LIABILITY FOR MARITIME CLAIMS, 1976, AND THE STRASBOURG CONVENTION ON THE LIMITATION OF LIABILITY OF OWNERS OF INLAND NAVIGATION VESSELS, 1988. VENUE FOR LITIGATION OF ANY DISPUTES UNDER THE PASSENGER TICKET CONTRACT IS EXCLUSIVELY IN THE COURTS OF BASEL, SWITZERLAND.
CLASS ACTION WAIVER: THESE TERMS AND THE PASSENGER TICKET CONTRACT PROVIDE FOR THE EXCLUSIVE RESOLUTION OF DISPUTES THROUGH INDIVIDUAL LEGAL ACTION ON YOUR OWN BEHALF INSTEAD OF THROUGH ANY CLASS OR REPRESENTATIVE ACTION. EVEN IF THE APPLICABLE LAW PROVIDES OTHERWISE, YOU AGREE THAT ANY LAWSUIT AGAINST US OR THE CARRIER WHATSOEVER SHALL BE LITIGATED BY YOU INDIVIDUALLY AND NOT AS A MEMBER OF ANY CLASS OR AS PART OF A CLASS OR REPRESENTATIVE ACTION, AND YOU EXPRESSLY AGREE TO WAIVE ANY LAW ENTITLING YOU TO PARTICIPATE IN A CLASS ACTION.
Carrier Information: For vessels flying the Swiss flag, the Carrier is AmaWaterways GmbH, an entity organized under the laws of Switzerland. For vessels in Portugal, the Carrier is DouroAzul, Sociedade Maritimo Turistica S.A, an entity organized under the laws of Portugal. For the vessel in Egypt, the Carrier is a partnership between AmaWaterways and Wings Tours & Nile Cruises, an entity organized under the laws of Egypt. For the vessel in Vietnam, the Carrier is Indochina Waterways, an entity organized under the laws of Vietnam. For the vessel in Namibia, the Carrier is Zambezi Queen Holidays PTY) Ltd, an entity organized under the laws of Namibia. Passport and Visas: A valid passport is required for each participant. For travel to Europe, at time of publication US Passport holders do not require a visa to travel. Passports must be valid for at least six (6) months after the scheduled return date to your home country, unless stated otherwise.
FUEL COSTS
If there is a substantial increase in fuel costs defined as Brent Crude above US$125 per barrel, Operator (AmaWaterways) reserves the right, upon 30 days notice, to demand a corresponding fuel supplement from Charterer (Stewart Travel Group). In that case, the additional costs will be shared on a 50%-50% basis between Operator and Charterer. Stewart Travel Group will reserve the right to request a supplemental payment from passengers to offset this cost.
Changes in Cruise and Cruise & Land Itineraries
Carrier seeks to provide services as published or stated in the Digital Travel Documents. But deviations to planned cruise, cruise & land itinerary or any other aspects of the travel may occur. If conditions make cruise routes unsafe for navigation or in other respects, or raise sufficient doubt about safety, Carrier reserves the right to modify or provide alternate services. These may include, but are not limited to, providing accommodation on the docked ship and/or substituting ground arrangements. An effort will be made to try to arrange elements of the cruise and cruise tour similar to those originally planned, but the level of similarity may vary. Except as otherwise provided in your Passenger Ticket Contract, such changes will not entitle you to any credit or a refund. Cruise, cruise & land routes, and all other aspects of the cruise and travel are subject to change with or without notice.
Cancellation by Carrier
Carrier reserves the right to cancel, change or postpone any cruise departure date and itinerary. In the event of a complete cancellation of a departure by Carrier, we will refund monies paid for the cruise or cruise & land package to those participants who have not previously cancelled. See Passenger Ticket Contract for further details.
Disabled Participants: Handicapped facilities are not available on board or in many places visited on the cruises and cruise tours we offer. If you (participant) have a disability and reasonable accommodation may enable you to use the services, please let us know how you believe we can help. Participant are requested to inform us in writing, at or immediately after making the reservation, but in any event as early as possible, of any mobility impairment or other condition, whether physical, emotional or mental, which may require accommodation or use of an assistive device during the travel. A reasonable effort will be made to accommodate special needs, but we are not responsible for denial of service by Carriers, hotels, or other independent Suppliers. A participant, who, due to impairment, is not self-sufficient, may need to travel with a companion who shall take responsibility for assistance needed during travel and in case of emergency. An individual with a disability that would result in a direct threat to the health and safety of others or to that individual may be excluded, if it is determined there is a significant risk that cannot be eliminated or reduced to an acceptable level by reasonable accommodations, policies, practices, procedures assistive devices or services. If participant fails to timely inform us of any impairment or condition and/or their participation poses a safety risk to participant or direct health or safety threat to others, participant may be excluded from parts or all of the travel. We shall have no liability to participant relating to any condition, treatment, failure to inform us of an impairment, or resulting exclusion.
Due to medical safety guidelines, we are unable to accommodate passengers who will enter their 24th week of pregnancy by the time of the cruise.
Medical: Medical doctors are not available on any vessel. If medical services are required, efforts to contact local medical providers will be made. A participant requiring such assistance is solely responsible for all related charges. We will not be responsible or liable for sufficiency of our efforts to reach medical providers, unavailability, delay, quality or other aspect of any such services. Participant is encouraged at time of booking and well before departure, to review participant’s health and medical conditions and insurance and consult participant’s health care and insurance providers regarding needs and scope of coverage for any incident or need that may occur during travel, and to obtain supplemental health and medical insurance for the travel, as needed.
Smoking: Smoking is only permitted on the ship’s Sun Deck in the designated smoking area. If a Passenger smokes in non-designated areas, such act constitutes a material breach of this Contract. In the event of such breach, Passenger forfeits all rights including the right to occupy the cabin and stay on board the ship. Carrier may also charge a reasonable cleaning fee to eliminate smoking odors.
Diet: Special dietary requests must be provided to us at time of reservation. An effort will be made to meet the request, but we cannot assure the request can be accommodated.
BAGGAGE LIMIT AND LABELING: Each Passenger may bring aboard the Vessel, without additional charge, up to one (1) suitcase. Additional Baggage will be subject to excess baggage charges. Passenger shall assure that all Baggage is securely packed and distinctly labeled with Passenger’s full name, Vessel name and sailing date, and Passenger’s cabin number.
NO PETS OR DANGEROUS OR ILLEGAL ITEMS OR ITEMS OR ACTIONS THAT MIGHT CAUSE DAMAGE TO THE VESSEL. Passenger shall not bring any animal (other than a qualified service animal of a disabled Passenger), dangerous article such as a firearm, explosive, flammable or combustible material or non-medical oxygen, alcohol, illegal drug, other controlled or illegal substance, or any other items prohibited by applicable law to, or aboard, the Vessel. If Passenger has any such item at time of embarkation, then before entry on the Vessel, Passenger shall surrender it to the Captain, and consents to the Captain disposing or destroying or giving it to authorities. Additionally, Passenger must not cause damage to the vessel or its contents, whether intentionally or unintentionally. You agree to accept responsibility, reimburse and/or indemnify Carrier for any loss, damage or expense whatsoever related to the presence of any service animal or any dangerous or illegal items brought on the cruise or related to any action that may cause damage to the Vessel or its contents. You further agree to determine and meet any documentary or other requirements related to bringing the service animal onboard the Vessel and agree that you may be removed from the cruise without compensation of any kind if any action is perceived by the Captain as being detrimental to the Vessel, its contents or to the comfort, safety, enjoyment or wellbeing of other guests.
VALUABLES: Hand or unlocked luggage, breakables, jewelry, money, precious stones, securities, financial instruments, tickets and any other valuables and personal items which include but are not limited to dental hardware, eyewear, hearing aids, medications and medical equipment, electronics, computers, cameras, and cellular telephones must be hand- carried by Passenger on and off the Vessel, and must not be included with check-in Baggage. Carrier shall not be responsible for loss of or damage to any such item under any circumstances.
Breach or Cancellation by Performing Artists
Stewart Travel Group Inc. has entered into an agreement with each performing artist on “2024 Blue Rodeo and Melodies of the Danube” to be present on board the Cruise and to perform in accordance with detailed itinerary. However, neither Stewart Travel Group Inc. nor AmaWaterways shall be liable or responsible for failure of any artist or musician to appear on board or to perform under its agreement. Further, neither Stewart Travel Group Inc. nor AmaWaterways shall be liable or responsible for any loss, damage, cost, or expense of any kind to any Guest or any other person or entity in the event that such performance is prevented or such loss, damage, cost, or expense is caused by or results directly or indirectly from any act of God, war, fire, collision, directions of underwriters, arrest, order or restraint by any government agency or official acting under color of authority, acts of terrorism, labor disturbances or disputes, civil commotion, weather conditions and considerations of the safety of the vessel (for which the Master shall be the sole judge), breakdowns of or damage to the vessel’s hull or machinery, requisition of the vessel by governmental authority, illness, death of a family member or other cause or circumstance beyond Stewart Travel Group Inc.’s reasonable control. In the event of any failure of contracted artists to perform during the cruise, Stewart Travel Group Inc., in its sole discretion, may try to engage a replacement artist or artists, or may change, postpone or terminate the entertainment program. In such case, Stewart Travel Group Inc. shall have no liability to any Guest for any loss, damage, cost or expense whatsoever by reason of such change.
TRAVEL INSURANCE
Stewart Travel Group Inc. HIGHLY recommends that each guest purchases Premium Protection Plan (Manulife) through www.stewarttravelgroup.ca under the INSURANCE BOX to protect their investment in case of i.e. Artist cancellation up to 1 day prior to River Cruise departure. If the guests decline Premium Protection Plan offered by Stewart Travel Group Inc., it will be mandatory to submit a Travel Insurance waiver form. By submitting this form, each guest will waive any liability against Stewart Travel Group Inc. or Avalon Waterways for any costs incurred as a result of their choice not to purchase Manulife Travel Insurance. Premium Protection Plan offers a wide range of coverages which include, Trip Cancellation, Trip Interruption, Emergency Medical, Baggage Loss, Baggage Delay, Flight Accident and Travel Accident. Public Performance
Stewart Travel Group Inc. has the exclusive right to include photographic, video and other visual portrayals of Passenger in any pictorial medium of any nature whatsoever for the purpose of trade, advertising, sales, publicity or otherwise, without compensation to Passenger, and all rights, title and interest therein (including all worldwide copyrights therein) shall be Stewart Travel Group Inc. sole property, free from any claims by Passenger or any person deriving any rights or interest from Passenger.
Stewart Travel Group reserves the right to substitute artists or activities without notice.
